 For those who are in dark thinking other wise, know that that Sammy Gyamfi is not running away from his allegation against. Afenyo-Markin. Rather, this is what it means:

Afenyo-Markin has sued Sammy Gyamfi for defamation over Sammy’s description of him as an “extortionist.” Sammy’s lawyers have now filed a motion challenging the jurisdiction of the court.

In simple terms, Sammy’s lawyers are saying: “Before this court proceeds to determine whether Sammy’s statement was defamatory or not, first determine whether this particular court has the legal authority and jurisdiction to hear the case in the manner it has been brought.”

That is a legal and procedural challenge, not an admission that Sammy lied, and certainly not proof that he is running away from his allegation.

If the court upholds the jurisdictional objection, the case may be struck out or directed to the appropriate forum, depending on the nature of the objection. If the court rejects it, the substantive defamation case can proceed, and Sammy will then have the opportunity to defend the statement on its merits.

Therefore, challenging jurisdiction does not mean Sammy has withdrawn his allegation or accepted that he defamed Afenyo-Markin. The court has not yet determined whether Sammy’s statement was true, false, defamatory, or justified.

So, before anyone concludes that Sammy Gyamfi is running away, they should understand the difference between a jurisdictional objection and a defence on the merits. They are two completely different legal issues.
